These Messaging Terms govern the communication features of World XP™ — the world experience powered by the DEASHA™ Framework — and are incorporated into the Terms of Service.
World XP™ provides messaging infrastructure. Customers create, target, and send their own communications and remain responsible for the legality and content of those communications.
These policies are provided for transparency and are intended to be reviewed and finalized by qualified legal counsel. They are not legal advice and do not guarantee compliance with every jurisdiction, industry, or regulatory requirement that may apply to a Customer.
1. Covered Channels
These terms apply to the following features, where enabled for a Customer's plan and configuration:
- Transactional and notification email.
- SMS and text messaging, where a sending number is provisioned.
- In-app and in-portal messaging.
- Push or progressive web app notifications, where implemented.
- Announcements and campaign messaging.
- Automated communications triggered by platform events.
Availability of a channel depends on the plan, the configuration approved during project kickoff, and provisioning with the relevant third-party provider. Features that have not been enabled for a Customer are not available simply because they are described here.
2. Customer Responsibilities
Each Customer is responsible for:
- Obtaining and documenting all consent required for the messages it sends.
- Maintaining accurate, permission-based contact lists and removing invalid or withdrawn contacts.
- Providing any notices required by applicable law at the point of collection.
- Honoring opt-out and unsubscribe requests promptly.
- Complying with applicable messaging, marketing, privacy, and consumer protection laws and with carrier and provider requirements.
- Ensuring message content is lawful, accurate, and appropriate for its audience.
- Maintaining accurate sender identification where required, including organization name and contact details.
3. Consent, Opt-In, and Opt-Out
Messages may only be sent to recipients who have provided the consent required for the channel and message type. Customers must retain records demonstrating consent and must be able to produce them on reasonable request.
Opt-out requests must be honored across all channels for which they apply. Where the Services maintain suppression lists or unsubscribe handling, Customers must not re-add or otherwise message suppressed contacts absent renewed consent.
4. SMS Provisions
Where SMS messaging has been provisioned for a Customer, the following apply to recipients of that Customer's messages:
- Message frequency varies depending on the program and the recipient's relationship with the sending organization.
- Message and data rates may apply, depending on the recipient's mobile plan.
- Where supported by the provisioned sending number and provider, recipients may reply STOP to opt out.
- Where supported by the provisioned sending number and provider, recipients may reply HELP for assistance.
- Carriers are not liable for delayed or undelivered messages.
Keyword handling such as STOP and HELP depends on the capabilities of the provisioned number and underlying carrier or provider. Customers must confirm which keyword behaviors are active for their configuration and must include appropriate disclosures in their own opt-in language.
5. Delivery, Filtering, and Failures
Delivery depends on third-party email providers, mobile carriers, spam filtering, recipient settings, and network conditions. We do not guarantee delivery, timing, or inbox placement. Messages may be filtered, throttled, rejected, or blocked by carriers and providers, including for reputation or content reasons. Persistent delivery failures may result in suppression of a recipient address or number.
6. Messaging Credits and Additional Usage
Plans may include a monthly allowance of outbound messaging credits. Usage above the included allowance may be billed separately or may require an upgrade, and carrier, provider, or number fees may apply in addition to subscription fees. Included allowances, overage handling, and applicable rates are those stated for the Customer's plan at the time of purchase.
7. Prohibited Messages
Messaging features may not be used for:
- Unsolicited bulk messaging or spam.
- Messages to recipients who have not consented or who have opted out.
- Deceptive, fraudulent, or misleading content, including phishing.
- Harassment, threats, or abusive content.
- Content prohibited by carriers or applicable law, including categories carriers commonly restrict.
- Falsified sender identity or misleading originating information.
- Messages containing regulated or highly sensitive information unless expressly supported by a written agreement.
8. Third-Party Carrier and Provider Requirements
Messaging depends on third-party providers and carriers with their own terms, registration requirements, content policies, and throughput limits. Customers must comply with those requirements, including any sender or campaign registration process. Providers or carriers may suspend or restrict messaging independently of us.
9. Allocation of Responsibility
World XP™ provides messaging infrastructure and tools. We do not review, approve, or assume responsibility for the legality, accuracy, or appropriateness of Customer-created campaigns, lists, or message content.
We may suspend or restrict messaging features where reasonably necessary to address abuse complaints, carrier or provider action, legal risk, or a breach of these terms, consistent with the Acceptable Use Policy.
